Who is responsible

We publish the YouTube channel “Error Bars”. YouTube is operated for European users by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

We are responsible for the content we upload — videos, descriptions, thumbnails. Our details are in the Impressum.

For the processing of your data when you visit the channel, Google Ireland Limited declares itself to be the controller.

Where the legal position is unresolved — and we are telling you

In the view of the German data protection authorities, operating a channel also creates joint controllership under Art. 26 GDPR for the channel statistics that YouTube provides to us. This follows from the Court of Justice ruling of 5 June 2018 (C-210/16), which concerned Facebook pages and is applied by analogy.

Google does not provide an arrangement under Art. 26(1) sentence 2 GDPR for YouTube channels. There is therefore no document setting out which controller fulfils which obligation. Meta added such a document for Facebook pages and the German authorities judged it insufficient; for YouTube there is not even that.

We are naming this because a channel whose point is precision cannot quietly omit it. It is a known, widely shared residual risk — public bodies in Germany run YouTube channels on the same basis. It is not a reason to assume your data is mishandled, and it is not something we can fix from our side.

What data we receive

Only aggregated statistics from YouTube Analytics: view counts, watch time, and summarised information about the audience’s country, age bracket and device type.

Comments

We do not answer comments on this channel. No exchange takes place in which personal data would reach us. If you write to us at the address on the corrections page, we process that e-mail only to answer it.

What Google does with your data

Google processes data for its own purposes, on which we have no influence and no insight: accounts, advertising and personalisation, recommendations, reach, security and abuse detection. Nothing is processed by Google on our instructions — there is no processing agreement between us and Google.

Transfers to the United States

Google also processes data in the USA. Google LLC is certified under the EU-U.S. Data Privacy Framework; the basis for the transfer is the European Commission’s adequacy decision of 10 July 2023.

Your rights

Access, rectification, erasure, restriction, objection and data portability. Because Google declares itself the controller for platform data, you can exercise these rights directly against Google, and we ask you to do so where the data is held there. You may lodge a complaint with a supervisory authority. For Google Ireland the competent authority is the Irish Data Protection Commission, 21 Fitzwilliam Square South, Dublin 2, D02 RD28, Ireland. For us it is the Berlin Commissioner for Data Protection and Freedom of Information.

No embedding

We do not embed YouTube videos in our own websites. Visiting our pages does not open a connection to Google.

Wo die Rechtslage offen ist

Nach Auffassung der deutschen Aufsichtsbehörden besteht für die uns von YouTube bereitgestellten Kanalstatistiken zusätzlich eine gemeinsame Verantwortlichkeit nach Art. 26 DSGVO. Grundlage ist das EuGH-Urteil vom 5. Juni 2018 (C-210/16), das Facebook-Seiten betraf und sinngemäß übertragen wird.

Google stellt für YouTube-Kanäle keine Vereinbarung nach Art. 26 Abs. 1 Satz 2 DSGVO bereit. Es gibt daher kein Dokument, das festlegt, welcher Verantwortliche welche Pflicht erfüllt. Meta hat für Facebook-Seiten eine solche Ergänzung nachgereicht; die Datenschutzkonferenz hat sie als nicht ausreichend bewertet. Für YouTube existiert nicht einmal das.

Wir benennen das, weil ein Kanal, dessen Anspruch Genauigkeit ist, es nicht verschweigen kann. Es ist ein bekanntes, breit geteiltes Restrisiko — auch öffentliche Stellen betreiben YouTube-Kanäle auf dieser Grundlage.

Welche Daten wir erhalten

Ausschließlich aggregierte Statistiken: Abrufzahlen, Wiedergabedauer sowie zusammengefasste Angaben zu Land, Altersgruppe und Gerätetyp der Zuschauerschaft. Einzelne Personen sind darin nicht erkennbar. Wir erhalten keine Namen, Adressen oder Kontaktdaten. Wir schalten keine Werbung und bilden keine Zielgruppen.

Wir beantworten auf diesem Kanal keine Kommentare. Es findet kein Austausch statt, bei dem personenbezogene Daten bei uns anfallen.
